BY ACCESSING OR USING THE SITE (AS DEFINED BELOW), YOU ACCEPT AND AGREE TO BE BOUND BY THESE TERMS OF USE (“TERMS OF USE”) ( PURSUANT TO WHICH YOU AGREE THAT DISPUTES BETWEEN YOU AND US WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION (EXCEPT AS OTHERWISE PROVIDED HEREIN) AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION) AND YOU REPRESENT THAT (A) YOUR ACCESS TO AND USE OF THE SITE WILL BE IN ACCORDANCE WITH THESE TERMS OF USE AND ALL APPLICABLE LAWS, RULES AND REGULATIONS AND (B) YOU ARE OF LEGAL AGE TO ENTER INTO A BINDING CONTRACT. The following Terms of Use are entered into by and between you and Mia’s Fine Jewelry (“Mia’s Fine Jewelry” or “we” or “us” or “our” or other similar pronouns) and, together with any documents incorporated herein by reference, govern your access to and use of the Mia’s Fine Jewelry’s website at www.mias.jewelry, whether accessed through the Mia’s Fine Jewelry website (desktop or mobile).

Availability and Pricing

All items offered for sale by Mia’s Fine Jewelry are subject to availability. All prices are shown in U.S. dollars including applicable taxes. All prices are subject to change without notice.

Taxes

You are responsible for any sales, use, duty, or other governmental taxes or fees (“Taxes”) due with respect to your purchase of items. We will collect applicable Taxes if we determine we have a duty to collect such Taxes. We will present an estimate of Taxes to be collected at checkout. The actual taxes charged may be adjusted from the amount shown at checkout. Several factors may cause this adjustment, such as variances between processor programs and changes in rates of Taxes.

Accounts

You may register for an account on the Mia’s Fine Jewelry website. We may refuse to accept any application for an account registration, or may cancel any account registration at any time, in our sole discretion. Your account is personal to you, and you may not share your account information with, or allow access to your account by, any third party. You are solely responsible for maintaining the confidentiality of your access credentials and other account information, and acknowledge and agree that you are and will be solely liable for any and all acts and omissions under your account, including any content that is posted or transmitted using the Site. Without limiting the foregoing, you agree to use reasonable efforts to prevent unauthorized access to or use of your account and to preserve the confidentiality of your username and password, and any device that you use to access your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security of which you become aware. You will be solely responsible for losses incurred by Mia’s Fine Jewelry and others due to any unauthorized use of your account.

Payments

Payment can be made by credit card, personal check, cashiers check, money order and wire transfer.
Payments made by personal check from first time customers will be held for 7 days.

By providing a credit card or other payment method accepted by us, you represent and warrant that you are authorized to use the designated payment method and that you authorize us (or our third-party payment processor) to charge your payment method for the total amount of your order (including any applicable Taxes and other charges). If the payment method cannot be verified, is invalid or is otherwise not acceptable, your order may be suspended or cancelled. You must resolve any problem we encounter in order to proceed with your order. In the event you would like to change or update payment information associated with your account, you can do so at any time by logging into your account and editing your payment information.

For credit card payments, the package must be shipped to the billing address entered at the time of checkout. The package can not be re-routed once it has been shipped.

Shipping

Mia’s Fine Jewelry offers complimentary insured Ground shipping on all orders placed and shipped within the continental United States. A signature will be required upon delivery.
To ensure the secure delivery of your order, Mia’s Fine Jewelry does not ship orders to post office boxes.

If preferred, we can provide expedited shipping options. You are responsible for paying any express shipping fees.

The shipping carriers used are UPS and USPS, depending on the value of the item/items.

Orders will be shipped within 3 business days from the date payment is received. Once the item/items are shipped, the delivery date will be in accordance with the 3rd party shipping carriers terms and conditions.
You agree that Mia’s Fine Jewelry is not responsible for any lost or damaged packages.

Returns

Mia’s Fine Jewelry offers a 7 day guarantee on our items. If you are not satisfied with your purchase through Mia’s Fine Jewelry, please email us the reason for your return to: mia@mias.jewelry within 7 days of the date on which the item was delivered to you.

Mia’s Fine Jewelry will review your request and get back to you as soon as possible.

All original packaging and your sales receipt must be included with the return.

All refunds will be issued to the original form of payment. Refund time varies based on the form of payment and the  payment processors Terms and Conditions.

Electronic Communication

When you access or use the Site, provide your e-mail address to us, or send us e-mails, you are communicating with us electronically. In so doing, you consent to receive communications from us electronically. We will communicate with you by e-mail. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communication be in writing.

Third Party Websites

The Site may contain links or connections to Third-Party Websites, and Third-Party Websites may link to the Site. “Third-Party Websites” include all websites, mobile websites, mobile and web applications, and services owned, operated or provided by any third party. The inclusion in the Site of any link to a Third-Party Website does not constitute an endorsement or sponsorship by Mia’s Fine Jewelry of such Third-Party Website, or the information, content, products, services, advertising, code or other materials presented on or through such Third-Party Website. Any reliance on the contents of a Third-Party Website is done at your own risk. When you access such Third-Party Websites, you acknowledge and agree that (a) these other websites and services are not under our control and we have no responsibility for the information, content, products, services, advertising, code or other materials provided by or through any Third-Party Website, (b) there are risks in accessing these Third-Party Websites, and you assume all responsibilities and consequences resulting from such risks, and under no circumstances will we be responsible for any consequences resulting from such risks or for the accuracy, legality, appropriateness or any other aspect of the content or function of such websites, and (c) additional or different Terms of Use may apply when you are accessing and using such Third-Party Websites. By using the Site, you release and hold Mia’s Fine Jewelry harmless from any and all liability arising from your use of any such Third-Party Website or your reliance on any content, goods or services provided by the relevant third party. If there is a dispute between you and any third party, we are under no obligation to become involved. You should direct any concerns to the relevant third party.

Governing Law

These Terms of Sale and your purchase of items from Mia’s Fine Jewelry will be governed by and construed in accordance with the laws of the State of Massachusetts, without regard to conflict of law principles. You hereby irrevocably consent to the jurisdiction and venue of the federal and state courts located in Pittsfield, Massachusetts with respect to any dispute related to these Terms and Conditions or your purchase of an item from Mia’s Fine Jewelry that is not subject to arbitration under these Terms and Conditions.

Indemnification

You agree to defend, indemnify on demand and keep Mia’s Fine Jewelry indemnified, and hold Mia’s Fine Jewelry harmless from any and all claims, liabilities, costs, losses (including without limitation consequential and indirect losses) and expenses, including reasonable attorneys’ fees, arising in any way from (a) your use of or reliance on the Site or any services, content, functions, information, materials or products available through the Site, (b) your purchase or use of any products through the Site, (c) your placement or transmission of any message, content, information, software or other materials through the Site, or (d) your fraudulent or deceptive acts or omissions, or breach or violation of the law (including infringement of any intellectual property or other right of any person or entity) or of these Terms of Use. We will provide notice to you promptly of any such claim, suit, or proceeding. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to assist and cooperate with our defense of such claim. In any event, you shall not settle any such claim without our prior written approval.

Limited License

Subject to the restrictions and limitations set forth in these Terms of Use, we grant you a limited license to access and use the Site for internal purposes of accessing and viewing the content on the Site on your computer or other Internet compatible device, including mobile devices and tablets. The Site and the services offered on or through the Site, including any content, software, code, data and materials thereon, are only for your own personal, non-commercial use. The Site is not directed to children younger and is offered only to users 13 years of age or older.

We will not knowingly collect personally identifiable information from any person that is actually known to us to be a child under the age of 13. IF YOU ARE UNDER 13 YEARS OF AGE, PLEASE DO NOT USE OR ACCESS THE SITE AT ANY TIME OR IN ANY MANNER.

We attempt to be as accurate as possible and to eliminate errors; however, we do not represent or warrant that the descriptions, pricing or other information is error-free. In the event of an error, we reserve the right to correct such error and revise your order accordingly.

These Terms and Condition take effect from your first use of this website. We may change these Terms and Conditions from time to time, at any time without notice to you, by posting such changes on the Mia’s Fine Jewelry website. It is your responsibility to periodically check these Terms and Conditions. It is your responsibility to check that you are still willing to be bound by any Terms and Conditions that may have changed. You will know if these Terms and Conditions have been revised since your last visit to the Site by referring to the “Updated” date at the top of this page. IF YOU DO NOT AGREE TO THE CURRENT VERSION OF THE TERMS AND CONDITIONS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO REFRAIN FROM ACCESSING OR OTHERWISE USING THE SITE.
